The Government Decision (No. 774, 21.11.2024) approved the Regulation on the procedure for engaging lawyers providing legal aid at the expense of the State Budget and their remuneration. This was reported by the Ministry of Justice.
The Regulation defines the procedure for engaging lawyers providing legal aid at the expense of the State Budget and their remuneration.
According to the Regulation, legal aid provided at the expense of the state budget is considered as qualified legal assistance provided fully or partially at the expense of the state budget in accordance with the procedures and conditions established by law, aimed at protecting the rights, freedoms, and legal interests of individuals.
The following individuals will receive legal aid at the expense of the state budget:
➖ disadvantaged persons (applicants or respondents in civil cases, applicants in administrative cases, individuals who have committed administrative offenses subject to administrative detention, as well as suspects, accused, convicts, and prisoners in criminal cases);
➖ individuals with mental health issues, when psychiatric help is being provided;
➖ individuals whose rights have been violated, regarding cases of violation of gender equality among women and men;
➖ in cases where the participation of a lawyer is mandatory in a criminal case, the suspect, accused, or convict.
Moreover, legal aid at the expense of the state budget will be provided to disadvantaged individuals who have committed administrative offenses subject to administrative detention.
Individuals apply to the justice department based on the principle of extraterritoriality orally, in writing or in electronic form to receive legal aid at the expense of the state budget:
electronic applications are sent through the "Legal Aid" information system after registering via the Unified Identification System (OneID).
oral and written applications are entered into the system without delay on the next business day after they are received by the relevant justice department.
Along with paying the lawyer in the amounts specified, travel and transportation costs are covered in cases where legal aid is provided in areas more than 50 km away from the location where the lawyer has signed the contract.
