The construction of the "Botanika" residential complex, which is being built in the territory of the old industrial zone located in the Mirzo Ulugbek district of Tashkent city, was halted due to the protests of local entrepreneurs. The decision of the Higher Court's administrative cases panel of inquiry dated January 27, 2025, served as a basis for this — the court found the positive conclusion given by the Tashkent city construction management to the entrepreneur for the construction of a multi-story residential building at this address to be invalid.
According to reports, United Industrial Equipment LLC appealed to the court, requesting to declare invalid the permit issued by the Tashkent city construction management on August 15, 2023, for the right to build a multi-story house in the old industrial zone, and the positive conclusion of the construction management dated September 22, 2023, with the number 95161354.
The Tashkent inter-district administrative court's decision on April 19, 2024, dismissed the LLCs' claims. Afterwards, the case was reviewed by the Tashkent city administrative court of appeal. A specialist from the Sanitary-Epidemiological Wellbeing and Public Health Committee of Tashkent city, who participated in the court, stated that the location where the "dom" is being built is located in an industrial zone, and according to the set requirements, residential buildings must be situated at least 50 meters away from warehouses, failing to meet existing sanitary standards.
The specialist from the Emergency Situations Department of Mirzo Ulugbek district also informed that the distance to the foundation of the "Botanika" multi-story residential building from the territory of United Industrial Equipment and Unieq Finance Leasing LLCs measures 4.6 meters at the closest point and 8.3 meters at the furthest, thus violating the required distance indicated in the building placement scheme. The initial court decision was altered by the decision of the Tashkent city administrative court of appeal on June 29, 2024, and the respondent Tashkent city construction management's positive conclusion dated September 22, 2023, with the number 95161354, was declared invalid. Additionally, the appellate instance court issued a private ruling against the Tashkent city construction management, specifying measures to rectify noted mistakes and deficiencies and to report the results to the Tashkent city administrative court within one month.
The appellate instance's decision and the private ruling were overturned by the decision of the Tashkent city administrative court of review on September 13, 2024, and the initial court decision was left unchanged.
