Shavkat Mirziyoyev on November 14 signed the law "On the Protection of Children from All Forms of Violence". This was reported by "Norma" here.
Due to the increase in cases of violence against children, the law strengthens measures to prevent and protect children's rights and legal interests.
All forms of violence, including physical, sexual, psychological, neglect, exploitation, and bullying, are banned and prosecuted by law.
Specifically, a victim of violence can appeal to the relevant authorities or court, and receive free legal, economic, social, psychological, medical, and other assistance at specialized centers, as well as through a free phone line.
For the first time, the law introduces a mechanism for issuing a protection order for children who have been victims of violence. It is issued by the internal affairs bodies for a period of up to 30 days and is handed over to the victim of violence or their legal representative. If the threat has not yet been eliminated, the validity of the protection order can be extended by a criminal court for up to one year.
The law reflects the right to claim compensation for material damage and moral harm suffered by the victim. Additionally, the document defines the main directions of the state policy in the field of protecting children from violence, the state bodies and organizations directly involved in this area, and their powers.
The National Social Protection Agency (authorized state body) is tasked with identifying children who are victims of violence, as well as those at risk of such violence, registering them, and taking individual measures to prevent violence where necessary.
At the same time, the responsibility of parents is increased. In particular, parents must protect their children's life and health, take care of them, protect them from harmful information, and corporal punishment of children in the upbringing process is prohibited.
The National Social Protection Agency provides a free 24/7 telephone network (helpline) throughout the country. The helpline operates confidentially. Except as provided by law, the disclosure of information received through the helpline is not allowed.
Individual measures to protect children from all forms of violence are applied as follows:
- identifying children who have been victims of violence and those at risk of violence;
- eliminating factors that pose a direct threat to the child's life or health;
- assessing the life situation of children who have been victims of violence and those at risk of violence;
- developing and implementing (where necessary) a protection plan for children who have been victims of violence and those at risk of violence;
- monitoring the implementation of the protection plan for children who have been victims of violence and those at risk of violence.
The National Social Protection Agency, in cooperation with other entities involved in protecting children from all forms of violence, participates in identifying children who have been victims of violence, as well as those at risk. The authorized state body, together with the internal affairs bodies, maintains a register of such children and ensures the implementation of individual measures to protect children from all forms of violence where necessary.
